Suspended police officer has assault charge dropped

A COMMON assault charge against a suspended Fraser Coast police officer has been withdrawn.

But Booral's Marc Charlton Withyman is still facing two other serious charges relating to another incident.

The 34-year-old did not appear in Hervey Bay Magistrates Court yesterday.

Instead a letter was sent from lawyers acting on his behalf, which stated that after case conferencing, the charge of common assault against Withyman had been dropped.

Police prosecutor Sergent Michael Quirk confirmed that was the case.

The common assault charge related to an incident at the Beach House Hotel on December 20 last year.

Withyman appeared in court last month and pleaded guilty to behaving in a drunk or disorderly conduct in relation to that incident.

Withyman is still facing two other charges relating to another incident earlier this year.

Those charges include assault occasioning bodily harm and attempting to pervert justice.

His case was adjourned until July 9 and his bail was enlarged until then.
