Drunk with hepatitis C who bit cop sent to jail

AN ABUSIVE drunk, who knew he was hepatitis C positive when he bit the arm of a Hervey Bay police officer, has been jailed for 15 months.

The Hervey Bay District Court heard Jamie John Brook bit a senior constable so hard, he drew blood and risked infecting the officer who still faces an anxious six months of testing.

The injured officer and his colleague had already attended Brooks' address once when they were called back to respond to another disturbance earlier this year.

On arrival they saw him hit his partner Krystal Taege over the head.

While being arrested, Brook kicked and struggled before opening his mouth and biting down on the arm of the officer.

Thw court heard officers were forced to resort to punching Brook in an attempt to control him before back-up arrived.

It took three policemen to subdue him and get him into the back of the van where he continued to yell and resist.

As Brook whimpered in the dock on Friday, his defence team said he was "sorry" for his actions and tendered references from Ms Taege who, along with his parents, was in court to support him.

The couple were said to have "reconciled" since the event and were living in a tent at a Hervey Bay caravan park.

Rebuking the attack as "shameful", Judge Leanne Clare said recent legislation had made it clear that assaults on emergency service workers would not be tolerated and Brook "must go to jail".

She said Brook had exposed his victim to a "real risk" of disease, which could be transmitted by saliva and the courts must act for the protection of police carrying out their duties.

As he was led out of the court on Friday, Brook called out "I love you" to his partner and parents.

He will be eligible for parole in March.
