18yo picked up 13yo for rough sex
AN 18-YEAR-OLD who used fluffy black novelty handcuffs to tie a 13-year-old Hervey Bay girl to his bed to have “rough” consensual sex walked away with community-based orders when he faced court.
The Sunshine Coast man, now 20, had picked up the young girl from a train station during the Christmas holidays of 2007-08, bought alcohol and cigarettes, told his parents she was older than her true age and then retired to his bedroom.
But it was not the first time the pair had had sex. The girl had been 12 the first time she performed oral sex on the older teen and then had sex in the back of his car in a Mount Coolum car park during the previous September school holidays.
They had a “sexting” relationship and he had also sent her photos, using his mobile phone, of himself naked in front of a mirror holding his genitals, along with the writing “hehe naughty :)”.
The man had taken photos of the girl naked on his mobile phone and urged her to send indecent photos of herself but she declined.
The girl once called him from her 13-year-old friend’s phone which resulted in the man “sexting” the second girl.
He also sent indecent images of himself to the second girl and urged her to reciprocate but she did not.
The man’s actions were uncovered when the second girl ran away from home and her mother found indecent text messages.
The man pleaded guilty in the Maroochydore District Court to two counts of unlawful carnal knowledge and three counts of indecent treatment of a child under 16.
Crown prosecutor Donna Semmens said the man’s actions were “predatory”.
“He sent them both phone credits when they were out so he could continue (the texting),” she said.
In her victim impact statement, the 12-year-old girl, now 15, said she had run away from home and dropped out of school because she could not concentrate.
“The impact on my family when this came out was terrible,” she said.
“He used me and it’s hard for me to deal with.”
The 12-year-old girl told police she had had sex with someone before.
Barrister Mark McAuley said his client had matured significantly, had apologised to the girls and told them he would not contact them again.
Judge John Robertson said the accused, who now has a long-term girlfriend, was unlikely to be a threat to young girls again.
He sentenced him to two years of probation and 200 hours of community service.
“But it was clear to me ... you had some understanding what you were doing was wrong.
“Obviously this has had a significant effect on the complainant in the unlawful carnal knowledge charges and her family.
“I suspect the genesis for all this is emotional and sexual immaturity.”
