Law working against public health staff trying to get jobs

A LAW meant to protect public servants is working against them as sacked health care workers try to get private sector jobs.

Fraser Coast Home and Community Care workers were encouraged to apply for roles in the private sector after the government outsourced their jobs.

But they found that non-government organisations were unwilling to take them on because of the Federal Government's Fair Work Act.

Under the Act, employees who leave the public sector and are hired in the private sector within three months must be employed under the same rates and conditions.

According to Together Union regional organiser Jim Nilon, many private organisations are unwilling or unable to meet those conditions, leaving the 35 health employees in the lurch when their jobs are terminated on Friday.

Health Minister Lawrence Springborg blamed the Federal Government.

He said Federal Workplace Relations Minister Bill Shorten's laws were now causing "unemployment and uncertainty" for State Government workers.

Mr Nilon said the same issue would be faced when aged care facility Yaralla Place went private - and that would mean 200 employees out of work with little hope of being rehired.

Mr Nilon said it was up to Mr Springborg to negotiate a way forward.

Ozcare, which takes over HACC services on June 1, was trying to ensure continuity of services, Ozcare's state manager of community care Damian Foley said.

"We will maximise any opportunities for employment within the local community," he said.
