Dad jailed for sexual attack on sleeping girl

A FATHER who crept into a Rainbow Beach home and sexually assaulted a woman has been jailed for 12 months, suspended after three.

Bryce William Peterson, 35, pleaded guilty to indecently assaulting the woman in November last year.

The court heard Peterson entered the home about 4am through a back door left ajar and went upstairs where two women were sleeping.

One of the women awoke to someone touching her stomach and felt the zip of her jeans being undone. The other woman, who initially thought it was her boyfriend when she woke, turned on the light and told the intruder, who was speaking incoherently, to leave.

Barrister P. Richards said the offence was out of character for his client who had no previous similar history.

He said the Agnes Waters father, who solely cares for his son, had not offended seriously and left the home as soon as he was confronted.

However, Crown prosecutor Joshua Hannah said the sexual assault was serious because it happened on a young woman who was asleep in her bedroom.

Judge B. Butler said the impact of finding a person in their house was high.

"The courts must ensure people feel safe in their own homes. What you did on that night violated that," he said.
