Man arrested following drunken fight at mum’s
AFTER a boozy night at his elderly mother's house, a 52-year-old man was found by police lying on a road wearing only shorts and surrounded by vomit and urine.
Prosecutor Sheena Hayes told Mackay Magistrates Court that on October 7, police attended a residence at Nebia-Coningsby Rd at Dumbleton after they heard reports of an intoxicated man.
When they arrived, they observed that Arcadia resident Michael Ray Davina was unable to stand, despite attempts, and had a strong smell of alcohol on his breath.
A car registered to Davina was stopped and idling in the driveway, with its doors open.
Ms Hayes said the man told police he'd been drinking red wine at a house in Farleigh, became involved in an argument and said he couldn't recall what had happened after that.
Ms Hayes said scratches on the man's arm indicated he'd fallen on the road, and he was taken to Mackay Base Hospital.
Defence solicitor Steven Hayles told the court that Magnetic Island resident Davina had been drinking alcohol at his mother's house.
Mr Hayles said an argument with his mother led to Davina drive away.
He said Davina was receiving a partial disability pension and accepted he had an issue with drinking.
Mr Hayles said he had since sought assistance from Alcohol, Tobacco and Other Drugs Service in Townsville.
Davina pleaded guilty to driving under the influence of alcohol.
Magistrate Nerida Wilson fined Davina $1000 and disqualified him from driving for 12 months.
