Sexting charges: Man fined for texting teen for nude pics

TEXT pest Calum Benjamin McKay had sent multiple text messages to a 17-year-old girl asking her to send him nude photographs of herself.

McKay, 20, had met the teenager at a scout camp some years ago and they had only maintained communication by text message and Facebook, Toowoomba Magistrates Court heard.

However, the girl hadn't heard from him for a while until she received a text on January 24 asking her to send him a nude photograph of her.

When she replied that she didn't want to do that, McKay had replied that if she didn't he would come and see her and "she wouldn't like what he was going to do", prosecutor Greg McIntyre told the court.

Feeling fearful and intimidated, the girl eventually sent a text carrying a photograph of her in a bikini.

McKay continued to send text messages asking for a nude photograph of the girl who eventually sent him a text with a photo of her topless, Mr McIntyre said.

The text messages eventually stopped and the teenager and her father went to police.

McKay was pulled over by police near Miles on March 27 and found to be wanted for questioning on the matter.

The self-represented McKay pleaded guilty to "using a carriage service to menace, harass or cause offence".

He told the court he had been partying with a friend over the relevant time and had been drunk when he sent the text messages.

Magistrate Damian Carroll described the offending as "grossly offensive" but took into account McKay had no previous criminal history.

He fined McKay $1250 but ordered the conviction not be recorded.
