Pointing a toy gun at the passers-by lands man in court

A MAN has escaped further punishment for pointing a toy pistol at people at All Abilities Park.

Kirk Foy Simpson pleaded guilty in Hervey Bay Magistrates Court on Thursday  to public nuisance.

Police prosecutor Senior Constable Donna Sperling said Simpson was seen pointing the toy gun at passers-by about 5.30pm on September 5.

Simpson has previously been jailed for six months for going armed to cause fear and public nuisance.

Magistrate Graeme Tatnell said if the matters had been heard at the same time the sentence would have been served concurrently with the jail term.

He convicted Simspon and declined to further punish him.
