Two brothers face court, one leaves on bail

A MAN accused of seriously assaulting police is also facing rape charges, a court has heard.

Two brothers faced the Mackay Magistrates Court yesterday for allegedly seriously assaulting police - one was granted bail while the other must remain in custody.

Magistrate Damien Dwyer refused to release the 24-year-old, who is in a "show cause" situation, also accused of two counts of rape against a 15-year-old girl. He cannot be named until he is committed to stand trial, and consequently his brother also cannot be named.

The man yelled out, "I love you mummy, I love you dad" as he was led away by a police officer.

The serious assault allegedly occurred about 10pm on Saturday, after police responded to a 000 call from a "very concerned female" who "was being pursued" by the brothers.

Prosecutor Sergeant Rebecca McDonald said the 24-year-old "acted as a party towards police" in relation to the serious assault.

"(The) actual violence has been conducted by (the other brother)," Sgt McDonald said. However, during the bail objection, Sgt McDonald said the 24-year-old was "heavily agitated" and "heavily intoxicated".

"OC spray was ineffective" and a taser was also ineffective at first. "It took a number of officers to restrain him," Sgt McDonald said. He posed a "risk to the community if released on bail," she said.

Defence solicitor Bill Potts said the man's parents believed he was "suffering from an undiagnosed psychiatric illness", such as bipolar, which was compounded when he drank alcohol.

They have serious concerns for his wellbeing, Mr Potts said. "He has the full support of his family."
